1. Introduction & Agreement to Terms
Welcome to SoftSpot® Connect ("Platform"), a service provided by PediaMetrix, Inc. ("we," "us," or "our"). These Terms and Conditions ("Terms") are a legal agreement governing your use of our platform, which includes the provider directory, AI-powered tools, the SoftSpot® Lite video submission feature, and related services (collectively, the “Services”).
By creating an account or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Services.
2. Important Disclaimer: Not Medical Advice
SoftSpot® Connect is an informational and educational tool, not a medical device. It does not provide medical advice, diagnosis, or treatment. Any information found on the Platform, including AI-generated summaries, quiz results, or content in our resources, is for informational purposes only. It is not a substitute for professional medical advice from a qualified healthcare provider.
Always consult your pediatrician or another qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read on this Platform.
3. Eligibility and Territory
- You must be at least 18 years old to create an account. Parents and legal guardians may use the Services for and on behalf of their minor dependents.
- The Services are intended for residents of the United States. If you access the Services from another jurisdiction, you are responsible for compliance with local laws.
4. Description of Services & Data Practices
SoftSpot® Connect allows parents to find and connect with providers, use informational tools like our quiz, and optionally submit videos for general evaluation via SoftSpot® Lite. The platform is designed to minimize the collection of Protected Health Information (PHI).
- No PHI Storage: The platform is not intended for the storage or transmission of PHI. Do not enter full legal names, dates of birth, or specific medical diagnoses into any free-text fields or upload media containing facial images or other identifiers.
- User Content: You retain your rights in the content you upload (e.g., videos submitted to SoftSpot® Lite). By uploading, you grant PediaMetrix a non-exclusive, worldwide, royalty-free license to use, process, and display your content solely to provide and improve the Services (including for quality assurance, safety, and AI model evaluation). We may delete or de-identify content that violates these terms.
- HIPAA: SoftSpot® Connect is not a HIPAA-covered service, and we do not act as a Business Associate. Providers must not use the platform as a medical records system.
5. User Accounts & Acceptable Use
You are responsible for your account credentials and all activity under your account. You agree not to:
- Share your account with others.
- Access the Services using automated means (bots, scrapers).
- Reverse engineer, circumvent security controls, or attempt to extract our source code.
- Upload content that is unlawful, infringing, or harmful.
- Use the platform for medical emergencies. If you have a medical emergency, call 911.
6. For Providers
- By creating a provider profile, you warrant that you hold all necessary licenses and certifications for the services you list.
- You are solely responsible for the accuracy of your profile information.
- You agree to use the platform solely as a directory listing and for initiating contact, not as a system for clinical documentation or patient management. All clinical interactions must be handled through your own HIPAA-compliant systems.
7. Intellectual Property & License
We grant you a personal, revocable, non-exclusive license to use the Services according to these Terms. All content on the Platform, including software, text, graphics, and logos, is the property of PediaMetrix, Inc. or its licensors and is protected by intellectual property laws. If you submit feedback, you grant us the right to use it without restriction or compensation.
8. Termination
We may terminate or suspend your access to the Platform at any time, without prior notice, if you breach these Terms. Upon termination, your right to use the Platform will immediately cease.
9. Disclaimers and Limitation of Liability
The Platform is provided "AS IS" and "AS AVAILABLE." We make no warranties regarding the operation of the Platform or the accuracy of information provided by third parties (e.g., provider profiles).
To the fullest extent permissible by law, PediaMetrix, Inc. disclaims all warranties. We will not be liable for any damages of any kind arising from the use of this Platform, including direct, indirect, incidental, or consequential damages.
10. Governing Law
These Terms shall be governed by the laws of the State of Maryland, United States, without regard to its conflict of law provisions.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes. By continuing to use the Platform after revisions become effective, you agree to be bound by the revised terms.
